Terms of Use

The rules for hosting creator-led Poco Loco races, playing through connected communities, and keeping the service fair.

Agreement

By accessing, hosting, or playing Poco Loco, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the service.

Eligibility and provider accounts

You are responsible for your Twitch account and any future connected provider account. Creators must only connect accounts they are allowed to use, and players must not abuse chat, impersonate others, or interfere with gameplay.

Creator races and chat access

To run a creator-led race, you may connect a provider account and open an Arena session. Twitch chat joins are planned as an adapter into the race lobby, but are not active yet. A creator may have one live race session at a time.

Extension and Bits

A Poco Loco Twitch Extension may allow viewers to use Bits to activate permitted in-extension digital gameplay experiences, such as unlocking a racer, revealing a track option, or adding race time. Bits interactions are not donations, sales, money transmission, gambling, or financial support for a broadcaster. Extension use remains subject to Twitch rules, these Terms of Use, and our Privacy Policy at /privacy-policy.

No unattended 24/7 channels

Poco Loco is for active creator-led gameplay. Running unattended, always-on, or 24/7 channels with Poco Loco is forbidden. Sessions may be limited, stopped, or cleaned up when needed to protect the service.

Fair play and acceptable use

Do not use bots, automation, view manipulation, scraping, attacks, harassment, unlawful content, score manipulation, or attempts to bypass limits, security, payment, provider access, or gameplay rules. BrokenChairMedia may limit, suspend, ban, exclude, remove, or withhold players and streamers from Poco Loco, gameplay, and leaderboards when needed to protect the service or community.

Data, XP, and leaderboards

We use provider usernames and avatars for identity, race entry attribution, XP awards, and leaderboards. Public gameplay and leaderboard surfaces may show player names, creator names, scores, ranks, race results, and related session statistics. XP is gameplay-only and is not money, a prize, or a financial instrument.

PocoPoints

PocoPoints (PP) are digital in-game currency for Poco Loco. PocoPoints (PP) have no cash value, are non-transferable, cannot be redeemed for money, and can only be used inside Poco Loco for supported in-game unlocks and features.

Purchases and payment

PocoPoints (PP) bundle prices are shown in EUR before checkout. Payments are processed by Mollie, and the available payment methods are shown by Mollie during checkout. Purchased PocoPoints (PP) are credited after Mollie confirms a successful payment. Failed, canceled, or expired payments add no PocoPoints (PP).

Refunds and withdrawal

Unused purchased PocoPoints (PP) can be refunded within 14 days by contacting [email protected]. Consumed PocoPoints (PP), earned PocoPoints (PP), free PocoPoints (PP), and test PocoPoints (PP) are not refundable. If approved, refunds are processed manually through Mollie. Mandatory consumer rights remain unaffected.

Payment disputes and account abuse

Abuse, fraud, chargebacks, payment disputes, rule violations, or attempts to bypass payment or gameplay systems may result in PocoPoints (PP) reversal, wallet suspension, account limits, leaderboard exclusion, or service access limits.

Service availability

The service is provided as available. Features may change, fail, or be unavailable because of maintenance, technical issues, provider changes, third-party outages, abuse prevention, or operational decisions.

Intellectual property

BrokenChairMedia and its licensors keep all rights in Poco Loco, including software, design, game systems, branding, and content. You receive a limited, revocable right to use the service as intended under these terms.

Liability

To the maximum extent allowed by law, Poco Loco and BrokenChairMedia are not liable for indirect damages, lost revenue, lost data, platform outages, provider enforcement, moderation decisions, or interrupted streams. Mandatory consumer rights remain unaffected.

Dutch law

These Terms of Use are governed by Dutch law. Disputes will be handled by the competent courts in the Netherlands, unless mandatory law gives you another court or right that cannot be waived.

These terms are intentionally concise. They are written for an international creator community, but Dutch law governs them unless mandatory law requires otherwise.
